1. Order # 1 (Commission) establishing this docket to inquire into electric transmission issues within the areas served by the Southwest Power Pool Regional Transmission Organization and the Entergy Corporation as those issues might impact the electric service within Arkansas. The SPP-RTO, all jurisdictional electric public utilities, the General Staff of the Commission, the Attorney General and the Arkansas Electric Energy Consumers are granted official party status. Anyone other than those designated official parties in this proceeding must file a formal petition to intervene pursuant to Rule 3.04 of the Commission's Rules of Practice and Procedure. The SPP-RTO briefing document shall be filed no less than 30 days after the filing with FERC of the next quarterly report of the SPP-RTO as the ICT (Independent Coordinator of Transmission) and should also include a briefing of the monthly activities of the SPP-RTO market monitor during 2008. After that filing, the Commission will establish an expanded procedural schedule allowing for reply comments and public hearings as needed. Dw

ORDER #2 (COMMISSION) ORDER OF CLARIFICATION: On the oral Motion of counsel for the SPP-RTO, the Commission clarifies Order No. 1 as follows: On or before October 30, 2008, the SPP—RTO shall file with the Commission its most recent Quarterly Performance Report submitted to the FERC and dated September 3, 2008. In addition, the SPP-RTO shall file on the same date the most recent monthly monitoring report filed with FERC on the SPP-RTO market (collectively “the reports”). Thereafter, the SPP-RTO shall file in this Docket such reports on the same date as they are filed with FERC. Order No. 1 also directed the SPP-RTO to file, as part of the briefing document, additional information and responses to certain questions. SPP-RTO shall file such additional information and responses on January 15, 2009. As stated in Order No. 1, the Commission will establish an expanded procedural schedule allowing an opportunity for reply comments and public hearings as needed once the SPP-RTO initial briefing information has been filed. kr

Order #10 (COMMISSION) The Commission directs the Independent Coordinator of Transmission (ICT) to file monthly reports on the results of the Weekly Procurement Process (WPP) including the costs and benefits of the experiment as it proceeds. The Commission accepts Entergy's offer to conduct a technical conference on the Construction Plan and the Base Plan. The Commission invites recommendations from the parties on how the different interpretations of Note B might be resolved and whether and how the Commission might advance the prospects of such resolution. The Commission directs the Southwest Power Pool (SPP) to conduct, with the assistance of an independent third party, a comprehensive cost/benefit evaluation of full SPP membership by both Entergy Arkansas, Inc. (EAI) (as a stand alone entity) and Entergy versus the existing ICT services arrangements, as opposed to the status quo ante. The Commission directs that the SPP report on or before July 1, 2009, on the progress in establishing a process for conducting such an analysis. The Commission directs the SPP to submit the results of the cost-benefit study by December 31, 2009. The Commission also directs the SPP to file a report by July 1, 2009, comparing and contrasting the transmission planning horizon used by the SPP as RTO with that of Entergy. The Commission also directs the SPP as an RTO, the ICT and the parties to make recommendations concerning what needs to be included in a seams agreement. The parties should file their recommendations and the information on existing seams agreements the SPP has currently executed should be filed by July 1, 2009. Ks

Letter from Arkansas Public Service Commission (APSC) to Fellow Entergy Regulators reaffirms its decision to join the Entergy Regional State Committee (ERSC) and has approved in principle the draft Bylaws dated August 18, 2009. The Commission agrees as followed: 1) that the ERSC should be composed of one representative from each retail regulatory body, and 2) the Public Utilities Commission of Texas (PUCT) that each retail regulatory body should have one vote as well as the concept that the adoption of policy statements should be supported by four out of five votes with only a simple majority vote needed for procedural matters. It is the Commission view the bylaws dated August 18, 2009 are sufficient to form the ERSC and address the regional cost benefit study in the short-term. The Commission believes it will be best to consider what other authority, if any, the ERSC will have in relation to the Entergy Independent Coordinator of Transmission (ICT) Agreement once the ERSC is established. In order to ensure significant progress toward the completion of a comprehensive seams agreement, EAI and SPP are ordered to file a seams agreement reflecting whatever issues have been agreed upon when they file their compliance report for the month of February 2010, which is due on March 1, 2010. In addition, EAI and SPP are to provide a detailed status report regarding the progress to date on all remaining issues and what needs to be done to complete work on these issues. Further, for the purpose of hearing from EAI and SPP regarding their efforts on completing a comprehensive seams agreement, the Commission will schedule a public hearing by subsequent order. Any additional development of issues regarding the Seams Agreement will be handled and all relevant filings should be made in Docket No. 10-011-U.
