Order#1 (Commission) conditionally granting Entergy's request for protective order of non disclosure; adopting General Staff's alternative suggestion "of a procedure for review of the interim status of all confidential information (not just Highly Sensitive Protected Information) and rejects the Company's assertion that such modified procedures would be "cumbersome…" The Order denies Entergy's request that no copies of the Highly Sensitive Protected Information be made. Voluminous protected materials shall be provided in electronic format if possible. For confidential information covered by this order, except for HSPI, the authorized reviewing representatives of an official party shall include its counsel of record in the docket and associated attorneys, paralegals, economists, statisticians, accountants, consultants or other persons employed or retained by the official party. Access to HCPI, other than Staff and the Attorney General, shall be restricted to those reviewing representatives who are not themselves and who do not represent others who are participants in the competitive electric energy and capacity market. Further certification is required for those persons. For each item of confidential information, the Company shall affix a written transmittal cover document in the form of Attachment 1 to the Order. Ted Thomas is designated as Commission Administrative Law Judge to review and examine all pleadings filed pursuant to Ordering paragraph 11 of this order. Upon completion of his review, ALJ Thomas is directed to issue an appropriate final Protective Order as may be needed, and any aggrieved party may petition the Commission for review of that Order.
