1. ORDER #1 - (Commission) Due to the high cost of energy the Commission submits a Notice of Inquiry (NOI) seeking information related to the most appropriate ways to increase the use of energy efficiency and conservation measures, to the benefit of the state, and all classes of customers. This NOI applies to the provision of both electricity and natural gas service. Specifically, the Commission is interested in determining what the balance should be among the following goals to be considered: Energy savings directly attributable to programs activities; Long-term and permanent changes in behavior, attitudes, awareness, and knowledge about energy savings and use of energy efficient technologies; Permanent peak demand reduction; Energy Cost savings and cost-effectiveness; Reliability enhancements; Environmental benefits; Economic development/competitiveness benefits; Increases in system-wide capacity; Accelerating the commercialization of advanced or emerging technologies; Improving affordability of energy for low-income customers; and any other criteria not listed above. In order to begin a formal inquiry into the issues related to energy efficiency programs in Arkansas, a workshop with interested participants to discuss the issues contained in this NOI will convene on February 21, 2006, at the University of Arkansas Cooperation Extension Service Auditorium located at 2301 South University, Little Rock, Arkansas. The workshop will begin at 8:30 a.m. and conclude by 4:30 p.m. All individuals shall register no later than February 15, 2006. Participants may register by sending an email to Joy Rice at joyrice@psc.state.ar.us. The email should identify the participant by name and organization represented. Prior to the first collaborative meeting all participants should review and develop a thorough understanding of the written comments previously filed in this Docket and, in addition, they should review the efficiency and conservation materials through the U.S. Department of Energy and the U.S. Environmental Protection Agency websites. On December 10, the Staff filed a letter with the Secretary supporting the establishment of a separate docket for this purpose (07-152-TF). Having considered the joint motion, the Commission finds it reasonable to grant the joint motion to withdraw the deemed savings reports filed by the utilities on April 2, 2007 and the revised one on May 1, 2007, and to permit the utilities to file their proposed initial deemed savings estimates and all future revisions thereto in the recently established 07-152-TF and foreclose any further considerations and filings of deemed savings estimates in docket 06-004-R. Noting the dismissal of the only pending appeal of the Commission's Orders and Rules in this docket, the Commission hereby directs the Secretary to close docket t06-004-R. Dw

Order # 22 (Commission) granting in part the joint motion in docket 06-004-R and requiring the following: A true up filing for the existing EECR for program years 2007-09 is due 4-1-09; a report on the effectiveness of those programs that have already been implemented, including EM&V savings, amounts spent on each program and in total due 4-1-09; A proposal for comprehensive program plans to be implemented starting in program year 2010 is due 7-1-09; and a proposal for cost recovery under Section 7 for the comprehensive 2010 and beyond programs is due 7-1-09. To satisfy these requirements,1) the true up for the ECR rates should be filed with supporting testimony in the original TF docket in which the programs were approved. 2) The effectiveness report, including EM&V, energy savings, amounts spent on each program and in total should be styled as informational in purpose and filed in the respective 2008 RP dockets. There should be no information in these reports that require Commission action. 3) The comprehensive program plans shall be filed with all supporting documentation and testimony, in the same originally assigned TF docket which will be used for this purpose as long as the C&EE programs are in effect. 4) The EECR rates for the comprehensive program plans shall be filed as part of the #3 filing above. In sum, all tariff and program specific filings shall be made annually in the original TF docket and informational filings shall be made in the utilities'/programs' respective initial RP dockets. Finally, by this Order, the Secretary is directed to reopen the TF dockets set up for these filing purposes. Order #23 (Commission) The various Comprehensive Energy Efficiency Programs and tariffs filed on or about July 1, 2009, and not previously approved in the 10 above-styled Tariff (TF) Dockets are hereby suspended. The Commission hereby directs that each of the investor-owned electric and gas utilities and the program administrators for the Arkansas Weatherization Program (""AWP"") and the Energy Efficiency Arkansas (""EEA"") program provide the following additional information using the two forms attached to the Order as Attachment A and B accompanied by explanatory testimony and reports if appropriate. The common procedural schedule is established: Completed responses to the two reporting forms (Attachment A and B) and accompanying testimony, exhibits, and comments shall be filed by the utilities and the AWP program administrator by noon on Friday, July 31, 2009; Responsive Testimony by the General Staff of the Commission (Staff) and Intervenors shall be filed by noon on Monday, August 31, 2009; Reply Testimony, if any, by the utilities and program administrator shall be filed by noon on Monday, September 21, 2009; Surrebuttal Testimony, if any, by the Staff and Intervenors shall be filed by noon on Wednesday, October 7, 2009. Separate public hearings in each Docket are set to begin at 9:30 a.m. back to back on Thursday, October 29, 2009 in Commission Hearing Room No. 1, 1000 Center Street, Little Rock, Arkansas. Entities desiring to intervene must still petition to intervene in any of the separate Dockets in which they wish to participate as an official party no later than July 31, 2009. Responses to Intervention petitions must be filed no later than August 14, 2009. The Commission will endeavor to issue final orders in each of these Dockets no later than Tuesday, November 24, 2009. js
