1. Order #1 (COMMISSION) Recent developments, including the Arkansas Court of Appeals’ decision issued in Entergy Ark., Inc. v. Ark. Pub. Serv. Comm’n, 2011 Ark. App. 453 regarding the indemnification requirement, indicate that changes to the [Net Metering Rules (NMR)] regarding indemnification are necessary. Accordingly, this Docket is hereby established for the purpose of receiving comments on said indemnification and any other provisions of the NMR that could present impediments to the development and use of net metering facilities in Arkansas. . . . Simultaneous Initial Comments shall be filed no later than 12 noon on Friday, February 24, 2012. Simultaneous Reply Comments shall be filed no later than 12 noon on Friday, March 16, 2012. ORDER #4 (COMMISSION) The Commission finds that the request of Entergy Arkansas Inc., and the General Staff of the Arkansas Public Service Commission that the state agencies' petitions be consolidated and that the agencies be authorized to proceed as a group is reasonable. The Commission grants the Petitions to Intervene of U of A System, Arkansas Tech, Arkansas Building Authority, Arkansas Department Human Services, and Arkansas Department of Correction on the condition that these entities intervene and participate in this proceeding as a single and united State Agencies Intervenor, retaining the rights to advance their individual positions to the extent they diverge from the group. Regarding the persons entitled to receive service and be included on the Commission Secretary's Official Docket Service List for the State Agencies group in this case, each entity forming the larger group is permitted to have one designated representative for service, for a total of five (5) people for the entire State Agencies group.
